Windsor resident Emilio Guzman Garcia, 35 has been sentenced to
to one year in county jail and probation after pleading guilty to
felony driving under the influence of an alcoholic beverage, felony
driving with a blood alcohol content of .12%, and driving with a
suspended license
Windsor police arrested Garcia around 1 a.m. On October 15 while
he was driving in the area of Old Redwood Highway and Starr Road.
The officer found a half-full can of beer on the front passenger
seat and three empty bottles of beer in the back seat.
The case is Garcia’s fifth DUI and prosecutors had urged the
court to send Garcia to state prison. Superior Court Judge Elliott
Daum did not follow the District Attorneys’ recommendation.
Garcia has already served one year in county jail after a 2005
DUI conviction. Garcia has also been convicted of possession of a
loaded firearm in a vehicle.
